New Round of Tariffs Announced

Late last week, the Office of the U.S. Trade Representative announced a new swath of tariffs following a series of Section 301 investigations. USTR identified 60 economies that it alleges have failed to impose and effectively enforce a prohibition on the importation of goods produced with forced labor. The announced tariffs are the expected follow-up to those that were struck down by the U.S. Supreme Court earlier this year. At the time, the Supreme Court decided the laws being used for global tariffs were incorrectly applied. This sent the Trump administration down the route of Section 301 investigations, which give strong legal backing to implement tariffs if violations in other countries are found.
Several organizations have already sued, arguing in part that the investigative process was inadequate. These investigations took place earlier this month, but past investigations have typically taken closer to a year or longer to do a full assessment. It remains to be seen if the legal actions will lead to preliminary injunctions.
