California Farm Bureau Supports BlueTriton in Water Rights Appeal

California Farm Bureau has prepared an amicus curiae brief in support of BlueTriton Brands Inc. in an appeal before California's Fifth District Court of Appeal concerning the scope of the California State Water Resources Control Board's authority to require water-right permits. The case involves whether water collected underground from historical spring systems can be legally classified as surface water subject to the board's appropriative permitting requirements.
Farm Bureau's brief supports the trial court's rejection of the board's asserted permitting jurisdiction and emphasizes the importance of maintaining clear statutory distinctions between surface water and groundwater. For farmers, uncertainty regarding water classification and permitting obligations can affect longstanding water facilities, irrigation investments and future operational decisions. While recognizing the importance of protecting existing surface-water rights, Farm Bureau argues that the board's permitting authority must remain within the limits established by the Legislature. The outcome could have broader implications for farmers and ranchers who rely on predictable water-right requirements when making long-term investments.
